Wal-Mart is attempting to move into a vacated Kmart building (approximately 99,000 square feet) in Marina, CA. According to the Planning Commission, the building was zoned to be divided into 2-4 retail anchor stores with smaller, local, visitor serving retail making up the rest of the 20-acre shopping center known as Marina Landing.

Citizens of Marina rose up in opposition when the city staff ruled the required zoning change was not subject to the California Environmental Quality Act and therefore did not require a new Environmental Impact Report even thought a report had not been done since 1998. The group is going to court to challenge staff's discretion and insist a new EIR be done.
