In Anne Arundel County, Maryland, any rezoning must show that the new classification conforms to the County’s General Development Plan (Comprehensive Plan) in “relation to land use, type and intensity of nonresidential buildings,” as well as “compatibility between the uses of the property as reclassified and the surrounding land uses, so as to promote the health, safety and welfare of present and future residents.” The burden of proof is put on the applicant to prove these findings. By having such criteria in place, the city has to come up with “findings” that prove these criteria are met, or they can be challenged in court.
