Evaluation of 24-Hour Uses (1994)

San Jose, California adopted a zoning ordinance “to develop measures to assure that 24 hour operations conform to policy regarding neighborhood compatibility and urban design…balancing the needs of business to respond to market trends while protecting the quality of life in nearby residential neighborhoods.” The ordinance says that 24-hour uses should “not be located within 300 feet…from any property residentially zoned, planned, or used.” This ordinance says that large-scale retail must provide “appropriate mitigation measures” which will be reviewed on a “case by case basis.” One condition mentioned is the provision of security patrols of the parking lot area.
