Interim Zoning Prohibiting Shopping Centers (1996)

New Paltz, New York The town passed an “interim rescission” of its zoning code, to “encourage and regulate the development of the appropriate scale shopping centers consistent with the general goals and specific objectives of the newly adopted Comprehensive Plan.” The New Paltz Comp Plan said the town wanted to “limit the size of new shopping centers in terms of site area and gross leasable area to a maximum density and scale in relationship to existing business and in keeping with the community.” The rescission calls for a ban on shopping centers of more than 45,000 s.f. in the Highway Business District. Stores in existing shopping centers are not allowed to expand beyond 50% of their floor area or 65,000 s.f., whichever is less.
