Following through on an excellent Comp Plan, Hailey provides a good example of the power of a local ordinance to prevent a huge company from swallowing a small town. The Hailey size cap requires: “1) Buildings or structures containing an Individual Retail/Wholesale Trade shall be limited to an aggregate gross floor area of 36,000 square feet. 2) Buildings or structures containing a Grouped Retail/Wholesale Trade shall be limited to an aggregate gross floor area of 72,000 square feet.” Hailey also carefully defines retail to insure that a large retail chain like Wal-Mart doesn’t skirt the law by proposing several individual buildings.
