Classic way to gain more control over big box stores. This ordinance applies to any retail store over 65,000 s.f. Must also have a section on Use Permits that spells out what the criteria are for denying a special permit. In this case the county must find that 1) the proposed use is consistent with the county’s general (land use) Plan 2) will not be detrimental to the health, safety and general welfare (which can include economic considerations) of the residents living or working in the neighborhood 3) will not be detrimental or injurious to property and improvements in the neighborhood. These are the criteria that a citizens group would then argue have not been met.
