North Carolina Tax Docs To Remain Public; WSJ Can Remain “Unreasonably and Unduly Annoying”

A Superior Court judge in Wake County, North Carolina, has denied Wal-Mart’s attempt to keep from the public any future filings in a tax dispute with state authorities.

From The Wall Street Journal:

The company asked the judge to issue an order sealing from public view any future filings of many of the documents the company turned over to the state as part of the discovery process in the case, as well as documents the state obtained from Ernst & Young as part of a separate, related court dispute.

The fact that any future filings will remain public is a good thing, although with over a half-dozen boxes worth of documents consisting of several thousands of pages having already been filed, its possible that this ruling may mean very little in the long run - its likely most of the juicy stuff has already been filed, and that which has already been filed was going to remain public anyway. Still, the fact that Wal-Mart wanted any prospective future filings kept from public eyes suggests The Wall Street Journal may have yet another opportunity to flex its “unreasonable and unduly annoying” muscles. Either that, or Wal-Mart just really wanted another public beatdown in our Nation’s state courts. My guess is the latter...we all know Wal-Mart has nothing to hide from our hungry eyes.

Wal-Mart loses bid to seal court papers in state tax dispute [The Wall Street Journal]

A North Carolina state judge rejected an attempt by Wal-Mart Stores Inc. to block public access to certain court documents in a tax dispute with state authorities.

The retailer asked a state court in North Carolina last month to have some future filings in a prominent tax dispute case sealed from public view. The company’s action followed a page-one article in The Wall Street Journal that detailed how Wal-Mart paid its outside auditor, Ernst & Young LLP, to design complex strategies to cut its state-tax bills.

The Journal posted several documents on its Web site that had been publicly filed months earlier as court exhibits by the North Carolina attorney general’s office, including internal Ernst & Young memorandums and correspondence with Wal-Mart.

In its motion with the court last month, Wal-Mart said that such postings caused “unreasonable and undue annoyance and oppression of a party that is attempting to litigate a serious dispute with a public agency.”

The company asked the judge to issue an order sealing from public view any future filings of many of the documents the company turned over to the state as part of the discovery process in the case, as well as documents the state obtained from Ernst & Young as part of a separate, related court dispute.

North Carolina’s attorney general, opposing Wal-Mart’s effort, argued there was a public interest in maintaining public access to the documents at issue.

In his order dated Nov. 20, filed with the court Wednesday, Emergency Special Judge of Superior Court Clarence E. Horton Jr. denied Wal-Mart’s motion. The order didn’t specify his reasons.

North Carolina’s attorney general is challenging a complex Wal-Mart tax-cutting structure involving real-estate investment trusts. The company transferred ownership of its stores to various in-house REITs and then cut its tax bill by taking deductions for rental payments that never left the company. Wal-Mart has defended the strategy as proper.

A spokeswoman for the North Carolina attorney general’s office didn’t reply to requests for comment. A Wal-Mart representative declined to comment.

I understand that WalMart stock is in a stagnant 5 year loss generating era. But that is no reason to cheat on the American taxpayer with false corporate state tax returns. That is however the best neighborly sense of responsibility WalMart has to offer the U.S. taxpayer/consumer.

I understand WalMart wanting to cheat its ‘associates’ on health care and cast them onto the states for welfare and again the taxpayers to pay for the basic needs of health care for these impoverished workers. WalMart’s multibillionaire stockholders are no doubt thankful for this small financial socialistic subsidy and multistate public largess for the world’s largest corporation.

I understand why WalMart stores are often filthy and improperly maintained and the states subsidize these WalMart locations while putting the other smaller ‘mom and pop’ generational stores out of business. Communities often need these WalMart poverty engines for the new poor that are being created to consume billions in tainted, defective, quisling contracted Chinese made junk.

Wrong again Matthew.  Do your research, Walmart has like twice as many employees on the welfare dole as other employers.  I’ve seen statistics and studies to back this up and I think only McDonalds comes even close to the amount of employees on state subsidized healthcare.

But this all makes sense considering Walmart is the biggest retail chain in the world and McDonalds is the biggest fast food chain in the world.

mv: Speaking of illegal aliens, tha’s what was used to build the WalMart behind my home. They were in full view everyday of city officials,would walk to and from the site eveyday for months. When the INS finally attempted to round them up,over two dozen of the ran right through my yard.It took till midnite to find them all. The news report on T.V. showed all the fake documents that were in their possession-phony driver’s licenses,social security cards-you name it. The INS official said it was very evident that these were phony docs. Evidently, not so much to WalMart and city officials. No fines were ever assessed against WalMart. ( Was it just coincidence that they were picked up AFTER 6 months,AFTER their job was completed??

Showing your ignorance again Matthew.  It’s simple math really.  A lot of retailers employ single mom’s for instance on a part-time basis.  Walmart being the biggest retailer would have way more of these employees than any other retailer.  And it doesn’t take a rocket scientist to figure out that many of these part-timers receive welfare to supplement their income.

I’m not disputing that other companies don’t have workers on the welfare dole just stating a fact that Walmart has more.  I happen to know a person that screens people for food stamps and medicaid in Eastern Oregon.  He sees numerous part-time employees of Walmart apply for benefits.  Coincidence?  I think not!
