The FEC Has Finally Gotten Back To Us On Wal-Mart’s Election Activities
Nine months ago, on a warm afternoon in mid-August, the following words were written by a very conscientious and wise organization...namely, us:
Today, several labor groups asked the FEC to investigate Wal-Mart. Last week, Wal-Mart Watch submitted a formal complaint to the Federal Election Committee last week, requesting an investigation of Wal-Mart’s political intimidation.
What followed included a copy of a Wall Street Journal article detailing efforts by the company to intimidate workers and discourage support of a labor-friendly administration, and text of the complaint we sent off to the FEC letting them know what we thought of Wal-Mart’s actions. And then we waited, nervously checking our mailbox for the FEC’s response...would they investigate? Would Wal-Mart be brought to task for their actions?
Well, needless to say enough time passed to make us only vaguely remember that the FEC even exists, which made it all the more surprising when 9 months after our initial inquiry, an answer was given to us. And the answer was not what we hoped. The good news is that the case warranted enough merit to be assigned to an attorney in the enforcement division. The bad news is that after taking his/her case back to the commission, the commission was divided on whether there was enough merit to proceed. The commissioners make the final decision by voting for or against a “reason to believe” recommendation (four affirmative votes are required to go forward with any enforcement action)...we obviously did not get the four votes. IF we decide to appeal, we do have the option to file a petition in the U.S. District Court for the District of Columbia.

What will this website decide to do next. Maybe you could appeal and have the elections results over-turned. I would really pursue this thing a teach that dirty WM a lesson they will never forget. Once the website over-turns the election results and the nation has to re-vote people will starting taking you a little more seriously.
I think the union model of forcing people to ‘volunteer’ to work the Democrats phone banks actually works better as far as influencing the outcome of an election.

Wal-Mart executives thought hiring well-known labor lawyer Eugene Scalia was a smooth move, but the negative attention generated by their new associate has been more of a headache.
Like his father, Supreme Court Justice Antonin Scalia, Eugene is recognized for his ultra-conservative views and legal work. He is closely associated with the right-wing Federalist Society and is law partners with Ted Olsen, who served as George Bush’s chief counsel during the 2000 Florida Recount.
Scalia has “distinguished” himself in legal circles by ridiculing worker claims of repetitive stress injuries as “junk science.”
Working inside and outside of government, Scalia has consistently fought for the rights of large corporations over working Americans.
During his 10 years as a labor lawyer, Scalia managed to represent only two workers. At the Department of Labor, Scalia undermined whistleblower protections and supported the Bush Administration’s efforts to limit overtime pay.
Scalia’s actions at the Labor Department even concerned several of his fellow Republicans. Sen. Chuck Grassley (R-IA) sharply criticized Scalia’s application of whistleblower protection provisions of federal law: “If this is the way the Labor Department intends to enforce the new law, then most corporate whistle-blowers won’t be protected.”
Unsure of his chances of being confirmed by the full Senate, the Bush Administration gave up on Scalia when his recess appointment expired in 2003.~~~~~~~~~~~~WMW
NOTE: The Labor Dep’t during the last Bush administration[headed by Elaine Chao,Mitch McConnell’s wife],was a veritable union busting tool. Interesting that a Supreme Court Justice’s son was selected to represent WalMart.
Wonder what loyalists are STILL in positions of power at the FEC?

Always good and interesting info from you ddrb, welcome back.
While the Bush fungus dies off administratively it is noteworthy that the Obama effort is going after corporate parking of profits outside the United States. WalMart created some type of subsidiary in the Cayman Islands no doubt like the REIT in Delaware or the subsidiary in Italy to evade Illinois state taxes.
Repatriation of overseas profits is not going to enjoy the ‘Bush 5.25% corporate free loader rate’ under the Obama interest of tax fairness. WalMart is like organized crime, it must be dealt with by way of a comprehensive plan.
WalMart- Ask not what your corporate tax free loaders can do for America, ask only why you are now part time at 20 hours a week and fired for no reason before you are eligible for health care benefits.

Union (AFL-CIO) Calls For Foreign Profits Tax To Fund Health Reform

WASHINGTON (Dow Jones)--U.S. labor unions are joining a push by the Obama administration to raise taxes on the foreign profits of U.S. multinationals.
An AFL-CIO official will urge a Senate committee Tuesday to use the proceeds from Obama’s tax changes - as much as $210 billion - to help fund an overhaul of the U.S. health-care system.
“In order to get health reform done, we cannot rely solely on savings in the system; we will need to identify additional revenues,” according to prepared testimony from Gerald Shea, assistant to the president at AFL-CIO.
“Beyond these savings, we urge the committee to consider broader tax reform options, including those put forth by President Obama,” including taxes on the overseas income of multinationals, he said.
Shea is slated to testify before the Senate Finance Committee on Tuesday about options to finance an ambitious overhaul of the health-care system to lower costs and provide coverage to 50 million uninsured Americans.
Shea said other options to pay for health care include raising the tax rate on the returns of private-equity and hedge-fund managers; repealing the “last-in, first-out” method of accounting; and letting the capital gains tax revert to 20%, all of which have been proposed by Obama.
