Victory! Cordova Beats Wal-Mart

It’s a sobering business, is Wal-Mart Watching. Monitoring Wal-Mart’s slow creep on the world economy can often be a bit gloomy, so it’s important to know when to take pause and celebrate. Today is one of those days.

One of the nation’s most visible site fights just ended last night, and it ended in defeat for Wal-Mart. And even better yet, it happened in Cordova, Tennesse (just outside Memphis) - and right in Wal-Mart’s backyard.

The Memphis Commercial Appeal tells us:

After about a year of fighting a tide of angry neighbors and cautious Memphis and Shelby County planners, Wal-Mart has abandoned its quest to put a “supercenter” store at Macon and Houston Levee roads.

“We’re done. We’re not going to build a store here,” Wal-Mart spokesman Dennis Alpert said just after the Shelby County Commission voted 10-3 Monday evening to reverse the Land Use Control Board’s July approval of the project.

Al Norman tells us that the plan is not 100% “fully dead,” and Wal-Mart still has a chance to appeal. But Wal-Mart says it’s done in Cordova, and the chances of it jumping through all of the hoops to push through another store plan are minuscule.

Congrats, Cordova!

Shelby County Commission rejects Wal-Mart Supercenter [Memphis Commercial Appeal]:

After about a year of fighting a tide of angry neighbors and cautious Memphis and Shelby County planners, Wal-Mart has abandoned its quest to put a “supercenter” store at Macon and Houston Levee roads.

“We’re done. We’re not going to build a store here,” Wal-Mart spokesman Dennis Alpert said just after the Shelby County Commission voted 10-3 Monday evening to reverse the Land Use Control Board’s July approval of the project.

The vote came on a citizens’ appeal. The commission and the Memphis City Council both needed to deny the appeal as stated in a joint resolution for the retail giant to move forward.

The matter is on the agenda for today’s City Council meeting. But the commission’s vote effectively ended the fight. Commissioners Mike Ritz, J.W. Gibson and Sidney Chism cast the three dissenting votes—despite the scattering of “No Wal-Mart signs” in a sea of about 100 people who appeared to oppose the supercenter.

Nationally, the retailer has met with opposition in several communities in recent years. Most have cited fears of traffic congestion, increased crime, decreased property values and concern about competition for local businesses.

In some cities, Wal-Mart spends years trying to win approval.

Wal-Mart and some Cordova neighbors wanted the global retailer to put a 151,908-square-foot store, plus about 20,000 square feet of outparcel space, at the intersection’s northwest corner.

But city-county planners and a coalition of neighborhood groups called Citizens for a Sustainable Growth—which asked for the appeal—believed the facility would be too intrusive and would promote too much traffic at the intersection of the two-lane roads.

The coalition said that although Wal-Mart pledged $2.5 million to widen the roads up to 1,000 feet from the intersection in all four directions, the county would have been compelled to spend taxpayer money to widen the roads even further.

Attorney Brian Stephens, representing the coalition, pointed out that other local supercenters were built on roads already improved enough to support regional traffic.

“The road situation cries out that we vote with the neighbors on this,” said Commissioner David Lillard, who represents the area along with Commissioners Wyatt Bunker and Joyce Avery.

“If we’re going to wait until the roads are in place, it ain’t gonna happen,” said Ritz, supporting Wal-Mart. Ritz also said the “second-guessing” scrutiny would scare off developers.

The opposition also said denying Wal-Mart’s proposal would be a win for “sustainability,” a urban planning buzzword that refers to developing one community without draining the resources of another.

The site is within 7 miles of two other Wal-Mart supercenter stores in Cordova. The retailer said a new store is needed in the area because the other two have a customer overflow.

Stephens also said the store would promote the sprawl that blighted and drained communities such as Hickory Hill. “We can do things a little smarter. We can do things a little brighter,” he added.

Attorney Mike Williams, representing Wal-Mart, pointed out that the commission had approved commercial zoning at the site nearly 10 years ago.

He said Wal-Mart has worked hard to appease planners and neighbors since it first applied for the site plan approval in December. The company revised its original application filed in December by shrinking the building’s size from 176,305 square feet and repositioning the building further from nearby homes.

It also abandoned its signature blue-and-gray exterior for a mostly brick building with earthtone signs with a new company logo.

Williams said the cash-strapped county would rake in $1 million to $1.4 million in sales tax revenues plus about $240,000 in property tax revenues annually.

MADD Founder Arrested assault with a deadly weapon

The founder of the Citrus County (Florida) chapter of Mothers
Against Drunk Driving (MADD) has been arrested and charged with
aggravated assault with a deadly weapon.

According to witnesses, MADD activist Leigh Gonzalez pulled out a
gun and put it in the face of a man outside a bar.

Although Ms. Gonzalez had falsely claimed to be a law enforcement
officer, there’s no evidence that she was attempting to prevent the
man from driving while intoxicated or under the influence of
alcohol.

The MADD founder recently stepped down from her post at the MADD
chapter, claiming that national MADD officers demanded too much of
the local chapter. (Note: The national office of MADD insists that
local chapters raise large amounts of money, all of which must be
turned over to the national MADD headquarters for use as it sees
fit.)

Gonzalez denies threatening the man and says the gun never left her
vehicle. She claims the victim overreacted when he saw the gun in
her car.

Over reacted!! It that what you call it when someone sticks a gun
in your face????

She is charged with aggravated assault with a deadly weapon.
According to Gonzalez’s arrest report, when the officer arrived and
heard that Gonzalez had pulled a gun, he asked her for the gun.
She directed him to the passenger side floorboard of her vehicle.
There the officer found a 9 mm Beretta handgun that had a magazine,
but was unloaded at that time.

The arresting officer interviewed two witnesses.
One said he saw Gonzalez drive up in her vehicle to where the man
and a woman were standing in the parking lot.
When the man and woman began to argue, the witness said, Gonzalez
stepped in and claimed her family owned the bar.

The witness said Gonzalez then pulled out a gun and put it in the
man’s face.

The witness added that Gonzalez then turned around and while
pointing the gun at other people, told them to leave.
She then put the gun back in her vehicle.

A second witness stated that she saw Gonzalez with the weapon in
the back of her pants.
She said she told Gonzalez to put the gun away.
At that time, she said, Gonzalez showed her that the gun wasn’t
loaded and put it back in her vehicle.
The witness claimed that Gonzalez told her she was a law
enforcement officer, but couldn’t produce a badge.

The man who lodged the complaint told The officer that he and a
friend were horse playing when Gonzalez suddenly walked up and put
a gun 6 inches away from his face.
He said Gonzalez threatened them, but stopped and put the gun away
when one of the bar’s bouncers came outside and began talking to
her.

“The victim stated that he was very afraid when the defendant put
the gun in his face,” the report states.

“The victim also stated that he thought he was going to die and
that he wanted the defendant prosecuted to the fullest extent of
the law.”

Gonzalez was booked into the Citrus County Detention Facility,
where her bond was set at $7,000. She could not be reached for
comment Thursday.

Her arrest report notes that she was apparently under the influence of alcohol at the time of her arrest.!!!!!!!!!!!!!!!!

Not to mention MADD founder Cindy Lightner was also arrested for DUI/DWI!!!!!!!!!!!!!!!

one wonders if these radical HYPOCRITES are Obama supporters too.

An anti-war protester has attempted to handcuff former Bush administration aide Karl Rove, who was speaking at a San Francisco mortgage bankers’ meeting.

A statement by the group Code Pink identified the woman as 58-year-old Janine Boneparth, who tried to put handcuffs on Rove in what she called a citizen’s arrest for “treason.”

Rove, who was speaking today at the Mortgage Bankers Association’s annual convention, elbowed Boneparth away as she was escorted off the stage.

In total, five Code Pink members were removed from the hall during Rove’s appearance. The organisation says none of the five women were charged.~~~~~~~~~~~~~~~

Obama Ignores Credit Card Donation Fraud

What do Bart Simpson, Family Guy, Daffy Duck, King Kong, O.J. Simpson, and Raela Odinga have in common?

All are celebrities; and with the exception of Odinga and O.J. Simpson, they also are fictional characters. And yet, all of them gave money earlier this month to the campaign of Barack Obama, without any apparent effort by the campaign to screen them out as suspect donors.

The Obama fundraising machine may owe its sensational success in part to a relaxation of standard online merchant security practices, which has allowed illegal donations from foreign donors and from unknown individuals using anonymous “gift” cards, industry analysts and a confidential informant tell Newsmax.

An ongoing Newsmax investigation into the Obama campaign’s finance reports has exposed multiple instances of campaign finance violations and has been cited in a formal complaint to the Federal Election Commission filed by the Republican National Committee on Oct. 6.

Though many of the known violations include donations in excess of the $2,300 per election limit on individual contributions and contributions from foreign nationals, the extent of the amount of fraud is hidden because of a loophole in federal election law.

Campaigns are not required to disclose contributors who donate less than $200 — and Obama’s campaign refuses to release their names, addresses, and donation amounts. Obama has collected a staggering $603.2 million. Most of the money — $543.3 million — has come from individual contributors, half of it from “small” donors Obama won’t disclose.

The Obama campaign has turned a blind eye to the possibility of donor fraud. Reportedly, during the heated primary battle with Hillary Clinton, the Obama campaign “turned off” many of the security features on its online donor page, allowing any person with a valid credit card number to donate using any name or address.

Typically, card merchants require a cardholder’s name to match critical personal details, such as an address or, at the least, a ZIP code.

Though in recent months the Obama campaign has tightened up security and restored some of the security features used by merchants to weed out fraud, it still has left open easy ways for potential credit card fraud, including techniques similar to those employed by terrorists and drug traffickers to launder illicit funds.

For example, on Oct. 14, an individual using the name “O.J. Simpson” participated in Obama’s latest small-donor fundraising drive, making a $5 donation through the campaign’s Web site.

Giving a Los Angeles address, he listed his employer as the “State of Nevada” and his occupation as “convict.” The donor used a disposable “gift” credit card to make the donation.

The Obama campaign sent O.J. a thank-you note confirming his contribution, and gave him the name of another donor who had agreed to “match” his contribution.

Four minutes earlier, an individual using the name “Raela Odinga” also made a $5 contribution, using the same credit card.

The real Raela Odinga became prime minister of Kenya in April and has claimed to be a cousin of Obama’s through a maternal uncle.

Obama donor “Raela Odinga” listed his address as “2007 Stolen Election Passage” in “Nairobi, KY.” This credit card donation raised no alarm bells in the Obama campaign.

A few minutes earlier, “Daffy Duck” gave $5 to the Obama matching campaign, listing his address as “124 Wacky Way, Beverly Hills, Calif.”

But just as with Odinga’s address, the “Wacky Way” address failed to raise any alarm bells or security traps on the Obama Web site. Daffy Duck also used the same credit card.

Within the hour, three other new donors gave $5 to the Obama campaign. They were:

Bart Simpson, of 333 Heavens Gate, Beverly Hills, Calif.

Family Guy, of 128 KilltheJews Alley, Gaza, GA.

King Kong, of 549 Quinn Street, Capitol Heights, Md.

Newsmax learned of these contributions, which were all made on a single $25 Visa gift card (oddly, the total was $30), from a source that requested anonymity.

Calling himself “Bart Simpson,” the tipster said he’d been following the Newsmax investigation of Obama’s campaign finance irregularities “with great interest,” & believed that some of the small donations were coming from gift cards — “you know, the type of disposable debit card you can pick up at Rite-Aid.

“I tried it myself a few days ago,” he said. “I’m attaching for you proof of the contributions I made in the names of Daffy Duck, Bart Simpson, Raela Odinga, and Family Guy.

“What this means is that the Obama campaign does no verification of the name of the contributor. With a normal credit card, this wouldn’t wor[k], but with these disposable debit cards, no problem!

“This needs to be exposed,”

The tipster attached the confirmation pages from the Obama Web site showing the names of the donors, and in some cases, the names of other Obama donors who had agreed to “match” their contributions.

None of the matching donors’ names appears in the Obama campaign’s public disclosures to the FEC.

Other donors with clearly fictitious names revealed previously by Newsmax, The Los Angeles Times, and blogger Pamela Geller include “Dertey Poiiuy,” “Mong Kong,” “Fornari USA,” and “jkbkj Hbkjb.”

Five major companies process the bulk of all credit card transactions made in the United States, The Obama campaign paid , Chase Paymentech, just over $2 million to process its online transactions.

When asked whether Chase Paymentech had any security feature that would allow it to identify individuals making contributions using gift cards, they declined to comment.

Other industry analysts, who asked not to be identified by name, account the sensitive nature of the issue, said that processors could track gift cards & debit cards “only by the numbers on the cards.”

There are no names associated with these cards, so as a processor, you have no way of knowing who made the transaction,” one industry analyst said.

“It’s like walk-around money. They could be handing these things out as perks” to newly registered voters or others, “& there’s no way of tracing who is using them.”

Ken Boehm, a lawyer with 30 years of experience in campaign finance law, said that such contributions were clearly illegal.

“Making a contribution in the name of another person is the only part of federal election law that actually carries a criminal penalty,” Boehm is the CEO of the National Legal and Policy Center, a conservative think tank in Washington, D.C.

The Obama campaign paid Synetech Group Inc. of Charlottesville, Va., close to $2 million to compile all of the campaign contribution data from online contributors, bundlers, telemarketers, campaign events, & direct-mail campaigns, & process it for submission to the FEC.

The sheer scope of the Obama fundraising juggernaut was “never contemplated by the FEC,” a company official said, asking not to be quoted by name.

“It’s a lot of data. You’re talking 7 million contributions,” he said.

The campaign itself is responsible for screening out fraudulent donors, not Synetech, he said. “I’ve been doing this for 30 years, & this is as well-managed as any [campaign]. It’s just huge. When it’s this big, any little thing becomes something more than it is.”

One of the biggest problems the campaign faces is fraud, he said. “It’s a colossal problem. They’re paying the campaign with other people’s money.”

Individuals such as “Doodad Pro” & “Good Will” who made hundreds of contributions to the campaign in excess of the legal limits were not working for the campaign, but for themselves, he insisted.

However, the campaign itself has solicited these “messy little transactions” in numerous e-mails to supporters.

For instance, just days before the Democratic National Convention in Denver, campaign manager David Plouffe sent an e-mail to supporters, asking them to “make a donation of $5 or more before midnight this Thursday, July 31st, and you could go backstage with Barack.”

Since then, the campaign has run several small donation drives, claiming to “match” donations of $5, $10, or $25 with an equal amount for a previous donor.

Newsmax put a series of questions to the Obama campaign more than a week ago in preparation for this article, such as whether its Internet contribution system automatically matches donors’ names & addresses to their credit card numbers, as is common industry practice with online stores.

Newsmax also asked if the campaign uses a similar security screen to match a donor’s name & address to the card number when the donor uses a debit card or a gift card.

Despite multiple requests from Newsmax, the Obama campaign declined to comment for this story.
