Wal-Mart Still Selling Bassinets Tied to Infant Deaths

The Chicago Tribune and Consumer Affairs bring news today that despite a warning from the Consumer Product Safety Commission, Wal-Mart is still selling a line of bassinets that has killed two infants.

The bassinets - which are sold exclusively at Wal-Mart - feature metal bars spaced farther apart than CPSC guidelines require. In some instances, infants risk slipping through the metal bars and suffocating.

Despite the warning from the CPSC and the harrowing testimonies of parents who have witnessed the crib’s fatal flaw, Wal-Mart is still selling the bassinets on its website and in its stores.

Wal-Mart Selling Bassinets Blamed for Killing Two Babies [Consumer Affairs]

Simplicity bassinets that are still being sold at Wal-Mart and on Wal-Mart’s Web site have been blamed for killing two babies.

An apparently faulty frame on the Winnie the Pooh 4-in-1 Simplicity Bassinet crushed and suffocated two babies according to family members and a police report. This is the latest in a string of six deaths blamed on Simplicity baby furniture, with the previous four followed by recalls of those products.

The most recent death occurred last week on Thursday when six-and-a-half-month-old Kennedy Brotherton slipped between the mattress and the side railing after the mattress came loose from the frame, her aunt, Melissa Brotherton, told ConsumerAffairs.com in a phone interview.

Kennedy’s body slipped through a space between the mattress and the railing until she dangled by her head on the lower bar of the railing and choked, according to Capt. Ron Copeland of the Shawnee Police Department in Kansas.

“She was laughing and smiling when her parents put her to bed,” Brotherton said. “They checked on her three times within an hour period. They were in the living room less than 10 feet away. She never cried.”

The first death occurred last fall when Katelynn Simon suffered a similar fate in the same bassinet. “The rail design allowed her to slip her legs through and as she kept inching out she slipped lower,” Simon’s grandmother, Lori Crammond, wrote in a complaint to ConsumerAffairs.com. “Finally, her lungs were unable to expand.”

The product appears to be sold exclusively at Wal-Mart and on Wal-Mart’s Web site. As of yesterday, ConsumerAffairs.com found the product at two Washington, D.C.-area Wal-Marts we visited. The bassinet comes in two different Winnie the Pooh fabrics with the product identifications 3123DOH8 and 3112DOH7 and sells for between $100 and $110.

Crammond wrote that she warned Wal-Mart of the dangerous bassinet last fall. “Wal-Mart is very aware of what happened but continues to sell it with a five star rating,” she wrote.

Wal-Mart has not returned two requests for comment made yesterday morning and this morning.

More than a million Simplicity cribs were recalled for the same reason from May 2005 to September 2007 in four separate recalls, after four children died and countless others were injured when they were trapped between the mattress and the railing.

These bassinets have not been recalled. But the government agency responsible for recalling dangerous products, the Consumer Product Safety Commission (CPSC), is actively investigating the matter, said agency spokesman Scott Wolfson.

“CPSC is ... aware of two tragic deaths involving babies that had been placed in Simplicity bassinets,” he said.

Both families said their goal is to warn as many consumers as possible."Our main concern is to get the product recalled,” Brotherton said.

Simplicity products are certified by the Juvenile Products Manufacturing Association (JPMA) and these bassinets carry the association’s seal.

The association gave no comment on the recent allegations against Simplicity’s bassinets. In a prepared response after the previous recalls, the association stated that “Simplicity’s products carry the JPMA certification seal because they have passed the comprehensive and rigorous tests and review administered at our qualified independent testing lab.”

The prepared statement did not address the concerns of the products they endorsed, but instead seemed to blame the dangers of the products on the parents.

“As with all consumer products, it’s important to follow the manufacturer’s assembly instructions,” JPMA said in the statement. “This recall should serve as a reminder to all consumers to regularly check their cribs to ensure that they are properly assembled, and all screws and bolts are appropriately tightened. Consumers should check with manufacturers if they have any concerns about product assembly.”

As for Simplicity, the company appears to be out of business. A phone call to the company’s headquarters was met with a prerecorded message stating “Simplicity, Inc. is no longer in business and we no longer service Simplicity, Inc. products.”

Two phone calls made yesterday and today and an e-mail were not returned by the company’s attorney, Rick Locker, who has many clients in the child product industry.

The product also is under the Baby Disney product line since the bassinet is adorned in Disney’s Winnie the Pooh characters. Disney responded last night but has not returned a subsequent phone call.

I would have to say that is a definately, not a maybe maybe not.  Also generally the manufacturer that starts the recall process, but “SFCA, the company that purchased the assets of Simplicity Inc., has refused to recall the products.” Also Walmart recalled it at the same time as the other major retailers so if Walmart was slow than so was everyone else.

Officially recalling an item and actually getting it off the shelves are two different things, especially when Wal-Mart is involved.

Why don’t one of you urban-dwelling activists go check out “Wal-Mart Stores Inc., Toys “R” Us Inc., Kmart Corp., Big Lots, Target, J.C. Penney” and see if you can still score a bassinet at any of them?

I recalled the article about Walmart-only cribs when the CSPC made its announcement, which seemed to imply the cribs were sold in several stores. Alas, now the WM site says this for both cribs:

“Important Note: This bassinet is NOT among the products recently recalled for safety risks by the U.S. Consumer Product Safety Commission (CPSC). For more information on that product recall, contact the CPSC at 1-800-638-2772.”

It would be better if they replaced “recently” with the recall date, but give them credit where its due.

While I can’t say for a fact that every Walmart pulled it off the shelves, I do know that even if they haven’t taken them off the shelves you can’t buy one because the register will not allow a sale on those items.  So are you worried about people stealing them?

My store never had them on the shelves so yeah I guess so.  Also there is a big difference between a recall because something is considered offensive because it kind of looks like an obscure symbol and a recall because of safety concerns which is what this thread is about.  Good job trying to change the subject again when the antiWalmart movement has been proved to have misled people, lied, or just not had their facts straight.

I’m not sure what ‘subject’ you’re talking about, Dave, but I’m questioning Wal-Mart’s proficiency at implementing recalls. It was quite awhile after the recall of those Nazi t-shirts that they were still showing up on the shelves, ergo, it’s a question of how quickly the chain of command responds to recalls.

It may be permissible for Wal-Mart to drag it’s feet when it comes to recalling “an obscure symbol”, but there is no such latitude with a product that kills babies.

If I recall correctly, there was NO ACTUAL “RECALL” on those t-shirts, but, instead Wal-Mart said only that they would remove them from their shelves!!  Have you actually seen some of them on Wal-Mart’s shelves?  Or, are you just buying into what someone else said or possibly just making it up?

Beloved by Mexicans for his dim wits, street smarts and playful disposition, long-running comic book character Memín Pinguín — a little black boy whose face resembles a monkey — is at it again.

His zany adventures chronicled in a hugely popular book series for decades are up for sale at your neighborhood Wal-Mart store in the Libros en Español section, right next to the store’s cadre of African-American books.

The latest issue: Memín para presidente.

By Shawnedria McGinty’s American standards, the image was shocking. The African-American woman who was shopping at the store on South Post Oak over the weekend immediately asked a store manager to remove the books from the shelves. A manager told her he would comply.

“I said, wait a minute: Is this a monkey or a little black boy?” said McGinty, 34, of Meyerland. “I was so upset. This is 2008.”

But as of Monday afternoon, the books were still on the shelves at many Houston stores, prompting community activist Quanell X to demand that Wal-Mart apologize for selling the racially charged books.

“Even Hispanics of conscious minds sense this is racist and that to sell this is totally unacceptable,” said Quanell X, who spoke in front of the Wal-Mart on South Post Oak and demanded officials issue an apology. “It is a disgrace — it’s an insult to all African-Americans.”

Quanell X, who was contacted by McGinty, requested a meeting with regional Wal-Mart officials.

A Wal-Mart spokesman said the books were removed late Monday at the Meyerland location, but would not say if the comic books would be pulled at other Houston locations. A Houston Chronicle reporter bought three Memín comic books for $7.44 each at another Wal-Mart on Dunvale.

“We will be evaluating the best course of action,” said Phillip Keene, a company spokesman.

Memín is no stranger to controversy. In 2005, the Mexican postal service released a series of new stamps commemorating the comic book character, who debuted in the 1940s. The stamps sold out quickly, but the debate endured and swirled between the U.S. White House and the Mexican White House.

To some in America, Memín’s stereotypical image of exaggerated lips and ape-like characteristics represents a racist period in the nation’s history when black-face characters were popular.

The stamps were deemed offensive by President Bush and a number of American leaders. Former Mexican President Vicente Fox said he didn’t understand what all the fuss was about and insisted that Memín’s image was not racist, but a beloved character embraced by all Mexicans.

Omar G., 45, who was shopping at the Meyerland Wal-Mart with his four American-born children, said he did not want his children to read it.

“I grew up reading the comic book as a kid in Mexico, but for here, it is offensive for some people,” said Omar, who did not want his last name published. “To see it here in Wal-Mart, I am surprised.” ~~~~~~~~~~~~~NOTE:Publishers Weekly wrote a piece on this, referring to WalMart’s removal of these comic books a “ ban”. RDS,would you feel more comfortable with the term “ban” on Nazi T-shirts,rather than recall? Either way, the PUBLIC reaction was the deciding factor in the removal from WalMart shelves. What SHOULD have been the primary issue,IMHO, is the JUDGMENT of WalMart to even market these items,in the first place,period!BTW,why are WalMart shoppers not offened enough to “jack back” on other offensive and poor judgment call issues like attempting to influence a large block of voters(their employees), in an effort to sway a Presidential election, to favor a candidate deemed to promote WalMart’s selfish,corporate interests?

THen why did you bring them up as if they were the same?  That was the whole point of my last post.  The t-shirt was not a true recall and had nothing to do with safety so there was no urgency in some stores to get it off the shelves.  With a safety recall the merchandise is pulled immediately and even if there is a poorly run store that doesn’t get them off the shelves as quickly as they should a sales restriction is put on the register so that you cannot sell them.

I brought up the Nazi t shirts to demonstrate that when Wal-Mart recalls a product, for whatever reason, they don’t always get it done.

If you rely on Wal-Mart for your children’s safety you are wrongheaded.  Caveat emptor, right, RDS? If you buy a recalled bassinet at Wal-Mart and it kills your baby, it was your choice.

I did what you said for some unknown reason, and went through the first three pages on the WMW search and none had anything talking about Walmart not pulling recalls fast enough.  I saw several articles blaming Walmart for recalls even though they weren’t exclusively Walmart products, but nothing about what you were talking about.  Good try though, I guess when you have nothing to back you up the best way to go is to tell the other person to do a search on it because you don’t want to “spoon feed” them.

I believe I said that there were no stories about Walmart not handling recalls efficiently so I would have to say yeah they handle them properly.  Somehow the lack of evidence against my claim didn’t deter me from believing what I already knew to be true.
