Wal-Mart Suffers Setback In Canadian Union Fight
From the Canadian Press via Toronto Globe and Mail:
Wal-Mart has lost a battle in the Quebec Court of Appeal to fight the unionization of its store in Gatineau.
The world’s largest retailer wanted the court to order Quebec’s labour relations board to order a secret ballot by store employees. The court refused to hear the appeal.
The board ordered the certification of one United Food and Commercial Workers local after between 35 and 50 per cent of workers signed union cards.
The local withdrew its union request in May of 2005. But another local submitted its request for accreditation the next day. However, the labour board had cancelled a union vote because the original local had withdrawn its request.
Wal-Mart challenged that decision, saying it should have been allowed to present arguments on the legality of the withdrawal. A company lawyer said the union can’t withdraw the vote without the employer’s consent.

i agree dave, i am sure that the exectutives in Bentonville are staying up all night trying to come up with somthing to foil this latest PRO-UNION vote.... i don’t think it will take vivid imagination however, they weren’t really enigmatic in Jonquiere when the said thanks but no thanks. Wal-Mart is certainly not afraid to let the world know how they feel about unions.

I don’t think that the same argument that the “store in not profitable” argument will hold water this time.
Tony
It’s to bad that the rest of the world has begain to see us as a blite, at least under this president, rather than the leaders and shining example to the world that we once were. And it truly is a shame that we have to look to our friends to the noth for leadership, but as of late we have to look somewhere besides the White House for it.

Dave,
By the standards you employ for us being a shining example, when was the last time we were a shining example. I believe we are still a good example for others to follow. Last months elections highlight this fact. Instead of violent revolution and protests to unpopular policies we had an election. The ruling party was voted out and a new one will take over in January. All of this was accomplished in a peaceful manner. I find that to be a great example of the beauty of democracy.

And the constant string of lies from the White House, The lies that were told the Amserican public as well as the world, to put us in a war for oil..........WITH A COUNTRY THAT HAS DONE NOTHING TO US...... Torture, illegal detaintions, the dismantling of the CONSTITUTION, the whole patriot act, illegal wire taps, the list is so long that I would literly be here for days listing them all. Don’t even start with the whole free elections argument. We all know that this administration rigged the last two, and what kind of example of DEMOCRICY does that send to the rest of the world. The list of violations from this White House has ruined any credibility that we had with the rest of the world. This administration has for the first time in my life made me ashamed to be American. But I do see light at the end of the tunnel. I do think that once this bunch in the capital is out , we will again start to lead in a positive direction as we did so well in the past.......... Don’t get me wrong I LOVE America, and Americans, and thats why I spend so much of my free time on this blog, I just hate what has happened to us in the last 6 years, and I don’t think that we have lead the world in a positive direction as of late.

With the exception of six Texas meat-cutters U.S. Wal-Mart employees are willing to sit on their hands and let the Beast of Bentonville have it’s way. And you speak of leadership?
Congratulations, Alex! Pay no mind to Tony “Jingo” Smith. If conditions improve for Wal-Mart associates, Canada will deserve much of the credit.

“We all know that this administration rigged the last two”
I thought this was a discussion of legimate ideas not whack job conspiracy theories. You should have thrown in Bush planned 9/11 as well. Why didn’t Bush rig this most recent election? If he rigged the last two he surely could have rigged the most recent one as well. So please next time leave your conspiracy nonsense out of your replies.
“I do think that once this bunch in the capital is out , we will again start to lead in a positive direction as we did so well in the past”
Honestly, do you think this bunch is really any different than the last. I highly doubt this will be the case. Power has a tendency to corrupt everyone equally regardless of ideology. Also, ask Nancy Pelosi about her wineries use of non-union labor. They are no different than the last bunch.

Since you attempt to appear so intelligent about the unions in Canada in relation to WM. Then answer this.
Union “A” got 35 to 50% of WM’s employees to sign a card for representation. What was this union and its local? Then they withdrew, now why did they do that?
Then the next day union “B” submits its bid for accreditation?
Did the workders request this substitute union? How did they get into the picture? Is this a legal procedure in Canada?
Then the labour board cancels the procedures because the local “A’ had withdrawn. WM wanted to present facts (so I read) in the first certification and then apparently requested a secret ballot. I don’t know about the type of arguments to have been presented, but I see nothing wrong in a secrect ballot.
The above is a problem that I have with so many posters on here in that the facts are never completed presented so that all can understand. Whether one be for a union or not.
Well Alex please explain for maybe you can get a link to the actual ruling in this matter (similar to what Someone did on the Insurance Blog) Thanks

Sorry to tell you that I do not know anything about the Gatineau union drive. To be honest, if a company is fair [Walmart is not] then they don’t need a union in my opinion.
What I do know is that Walmart does not respect the workers who make their company tick. All one has to do is read the headlines.

As I posted on another thread, your posts on WM worker abuse in Jonquiere gets quite old and serves no purpose.
Now let us suppose we are in a courtroom and I ask this
question of you: Specifically what is the “abuse” that was
suffered by the workers at Jonquiere’?
If you know anything about law you would have to answer
this question and “not beat around the bush” with generalities. You would have to answer the point and prove it to win the case. Since law is a longtime endeavor of mine
(I am not an attorney) I would appreicate your response.
Thank you

knowledgeable, if you don’t know, then don’t expect me to do your research.
As far as the other person, first what is the yardstick for measuring what an expert is in this field, and second show me where I claimed to be either an expert or not and then you can ask real questions.

I wouldn’t bother asking Alex any questions, he has a way of always sidestepping them. He apparently has very little faith in his cause, otherwise, he could provide some defense to his positions. Alex perpetually lives in the spin zone.

This was a question by you in response to a joke by me. If I am held to this standard so you should be to. You are all over this site offering your two cents about labor issues as if you really know something. So sir answer the question are you an expert in the area of labor relations. Do you have a degree in it? Advanced study in it? Or are you always just talking out your ass? Have a nice day.

Your answer (no answer( disappoints me for it does show your lack of knowledge and/or expertise in the matter.
I will answer the question you posed (as an answer). Yes
I know the answer. Anytime an attorney in a court room asks a question—he knows the answer, but he wants to get a response from the party he is questioning. This gives him
(the attorney) the amunition required to win his case.
Alex you mentioned something about “another person being an expert” etc. Where did I ask you or say anything about an other person?? A fundamental of law is: words mean what words mean. You have to read what is written so that your words mean something.
Alex take some advice from a person much older than you, with by far more exposure to the business word (unions, non-unions, independent unions, business ownership of several, leadership roles, etc. Perhaps I seem to be bragging but my backgound in quite extensive.
My greatest assest though is my relaltionship with our Lord

To answer your recent post. Please tell me where I ever wrote that Wal-Mart was a good company? Maybe in a specific matter, I might have, but not overall. Or did you post have no reference to me? You weren’t specific as usual.
Kindly read all of my posts and you will see they are on both sides, I give credit where it is due. Do you recall my original posts on the Jonquiere/Union subject? Read them
before you post what side of the fence I am on.
Ken V—not pompous, but my post was most factual. Sorry that you cannot accept and can only name call. Bothers me
not. My “disease” is the truth. What is yours?
For both of you (Alex & Ken V) and others, you will find if you review previous posts, that I have been accused of
both being a WM lover and a WM hater. Such is an oxymoron, however truth becomes the stabilizer.
