Wal-Mart - which relentlessly markets itself as a wholesome, all-American brand - claims that it helps people “live better,” but it doesn’t seem that way for David McCarty from central Kentucky. After months of dealing with a Wal-Mart construction right in his backyard, McCarty decided to stand up for his rights...by sitting down. Lone man’s sit-in against Wal-Mart ends peacefully [Courier-Journal (KY)]
Complying with a court order, a Central Kentucky man today ended his sit-down protest a few feet from a blasting site — part of the construction of a Wal-Mart development adjacent to his property.
As dusk approached, David McCarty took refuge in his house just outside Lebanon before workers set off the dynamite near his back fence.
On Wednesday, weary from months of the nearby construction work and angry over what he said was damage to his property, McCarty had been determined to keep Wal-Mart from detonating the dynamite to make way for a water line.
So he spent that night sitting with his daughter, Kim Osbourn, in his backyard only a few feet from the dynamite, which had already been placed in the ground.
That led attorneys for Wal-Mart to request a restraining order against the McCartys today.
And Marion Circuit Judge Allan Ray Bertram, citing safety reasons, ordered the McCarty family to remain inside while the charges were detonated.
The explosions occurred about 5 p.m., ending an exhausting couple of days for the family, whose members say they dealt with daily noise, dust and debris for about four months before deciding to take action.
McCarty’s wife, Penny, said the family just wanted to “make Wal-Mart act like they’re not such a power and think they can run over anyone they want.”
She added: “We can’t even go outside to enjoy our grandchildren.”
Today, after attorneys for Wal-Mart filed their request for a restraining order, a family friend recommended that the McCartys hire Shepherdsville-based attorney John Spainhour, who met the couple at the courthouse.
During the hearing on the restraining order, the Wal-Mart attorneys agreed that crews would not detonate any more charges on the south side of the property near the McCartys’ back fence, said Jason Wetzel, a spokesman for Wal-Mart.
But the company would not agree to stop blasting on the east and west sides, which are much closer to the house, Spainhour said.
However, Wetzel said that issue was not addressed today and that Wal-Mart is “working to address the concerns of the homeowners.”
The controlled charges already in the ground had to be detonated, Wetzel said.
“To my knowledge, once it’s placed in the ground, there’s no other safe alternative,” he said. “But our top priority is Mr. McCarty and his family.”
Today workers covered the explosions so that rock and other debris did not scatter. They also used trucks that pumped water into the air to cut down on dust particles, Penny McCarty said.
The police couldn’t intervene in the stand-off because neither side is breaking the law, said Shelton Young, chief of the Lebanon Police Department.
“There was no legal basis for us to make him go in or stop (construction workers) from detonating,” Young said. “The homeowner was just as cordial and courteous as could be to the officers and to the Wal-Mart construction people. The workers weren’t aggressive either. We stayed for a couple hours to make sure everyone was keeping friendly and then we left.”
The court appearance stemmed from a standoff that started Wednesday after McCarty decided he “wasn’t going to just deal with it” as Wal-Mart construction crews planted dynamite a few feet from where his half-acre of property ends.
The explosives were needed to break through a rock layer for the water line.
McCarty, 59, said he walked into his backyard to find workers digging holes for the dynamite just behind his fence. They then ordered him into his home, he said.
“I told them, ‘If you wanna blast, you go ahead and blast. I’ll be right here,’” he said in an interview with The Courier-Journal late Wednesday night.
McCarty upended a white plastic bucket near the fence and sat on it, making it impossible for the crew to safely set off the dynamite. Before night fell, workers put plastic over the dynamite-filled holes and brought in someone to guard them.
McCarty remained in the yard throughout the night, although he did take bathroom breaks and replaced the bucket with a lawn chair.
The McCartys, who have lived at 2040 Campbellsville Road just outside the Lebanon city limits for 10 years, are now surrounded on all sides by the development.
“They are literally on an island in a sea of construction,” Spainhour said of his clients. “You can’t stand in his yard without getting covered in dust.”
Spainhour showed up at the courthouse shortly after the family told him about the case and asked for his services. He said he is researching and evaluating what legal recourse the family has against Wal-Mart, which is the world’s largest retailer and the state’s largest employer.
McCarty said he is eager to sell his property.
“I want out of here,” he said in an interview late Wednesday night.
Penny McCarty, 58, echoed that sentiment tonight, noting that none of them got much sleep Wednesday night.
Her husband said he gave a quote for the land to Wal-Mart officials, but would not specify the amount. He acknowledged that the quote was more than the property is worth.
“It may not be worth it right now, but when the new Wal-Mart is up and running, it will be worth every penny,” he said.
When asked about purchasing the McCarty property, Wetzel reiterated that Wal-Mart is trying to address the family’s concerns.
He said he did not think there had been any other complaints from the community about the construction project.
“Overall, I believe the community is looking forward to the Wal-Mart Supercenter being completed,” Wetzel said.
The typical Supercenter construction project takes eight to 10 months, depending on weather and other circumstances, he said.

The particulate matter being dispersed may very well be a violation of the Stormwater ProtectionPlan(SWPP) required as a part of the initial permitting process.It may sound incongruous to think that dust control is related to stormwater,but these Federal SWPP plans,require these measures, and ,DO stipulate that dust must be controlled by water trucks,or other means.Also,the decibel levels of the blasts may be in violation of OSHA and World Health Organization standards of acceptability.(Walmarts well documented and extensive history of shoddy construction practices re:stormwater runoff,lack of dust control,creating landslides with blasting has resulted in multiple actions by the EPA against WalMart and the contractors hired to do these projects.The EPA website has much info on these issues.)

Ken V: Your welcome.Ive been monitoring this site for several months now(PutnamLIVE),and,as I said in earlier posts ,you can choose to shop or not at Walmart,or to work or not at Walmart,but “Home Invasions"by the Bentonvillains is often akin to corporate terrorism in its tactics.Confidentiality agreements between realtors,and in some cases,local,state and federal politicians veil the fact that a Walmart may even be a possibility in your own backyard.The construction phase has received little press,but it is more often than not,an environMENTAL nightmare! But the insanity doesn’t end with the completion of the project-once its open,crime,devaluation of property,noise pollution,air pollution,traffic jams,etc. ad infinitum-WalMart..Sam’s Dream.. Homeowner’s Worst Nightmare!(BTW...Many off duty police officers work at WalMarts-thats another reason why ignoring ordinances is more often than not the rule rather than the exception.)

Guess that depends on what your view of ‘progress’ is!! Take a city like Dallas, at one time, it was a small city, but, look at it now, would anyone dispute that Dallas has progressed? Didn’t they destroy many farms, etc. to create what now is Dallas? And, isn’t Dallas an example of urban sprawl itself? Maybe it would be good if Dallas, went out of business, right?

Now let me ask you some questions: On any given day, are there any cars, other than those belonging to the employees, in a Wal-Mart parking lot? Who is it that is supposed to be the recipients of the ‘customer service’ you claim is lacking at the stores? Who is it that are in those LONG lines, you claim are almost constantly at Wal-Mart? Are those people NOT constituents of those mayors and city councils? Or, should a community look out for YOUR needs and welfare ONLY? “Hold on a minute, we had better check to see if it is okay with ddrb, before we allow this store to be built”!!

RDS, before I get permanently-banned from WMW for being a bore, I offer you a little something in rebuttal to Kenny’s “they all sell to Wal-Mart” comment:
The current E. coli outbreak has nothing to do with China, Wal-Mart, or even SDV, for that matter.
What it does have to do with, is unsafe conditions at the meat packing/processing plants in question.
Broken-down to the simplest common denominator - workers at these plants are not practicing proper food handling/equipment sterilization techniques.
We’re talking American workers, at plants that are supposed to be inspected/certified by the U.S. Department of Agriculture on a recurring basis.
We all know that’s not happening - some blame it on lack of tax dollars diverted to USDA, while others blame Wal-Mart, and even because it’s Tuesday…
If anyone has a concern with food safety (and we all should!), let your voice be known to your elected officials in Washington (hint: the hyperlink is usually imbedded in Screwy’s name at the end of his posts) - your Congress-people have the power to say where your tax dollars are to be spent.

RDS:"Sounds like you live in a corrupt city..."Yes,it is,like many other cities whose local,state,and federal agencies are influenced by greed and big business lobbying efforts.How do you think so many WalMarts are built over the objections of local groups(If they even know a Walmart is on the horizon in time to rally against it.) Back door deals,and permitting processes that do not provide full and fair disclosure in a timely manner are classic ploys,as are the confidentiality agreements.I would suggest you read Al Norman’s books or go to Sprawl-busters website for unlimited info on this subject."Gee,and when Nick cited statistics...."Firstly,I wasn’t posting when these statitics you refer to were evidently posted.But,RDS, quoting numerical stats from Economic compilations is not the same as the human suffering and death that arereflected in the police crime statistics reports.Does anyone know if there are any newer stats on crime at Walmart and Sam’s...somebody oughtta start a website just to compile these numbers.

I love Walmart. Walmart has done more good for our economy than bad. Walmart has been responsible for keeping inflation in check by providing products and services at very low cost. While everything else seems to be going up, i.e. the price of fuel, my state and federal taxes, my heating costs, the prices at Walmart have been going down. How can this be a bad thing? I think all of you people who are opposed to Walmart are idiots who have nothing better to do than to bitch and complain about a well run, well organized, professional company like Walmart. Stop wasting your time with this nonsense. Loosers.
