Wal-Mart foes vow to continue fight [St. Louis Post-Dispatch]
ST. PETERS — An attorney representing opponents of a St. Peters Wal-Mart said Wednesday that he expects to appeal the matter after a St. Charles County judge declined to reconsider the case.
Nelson L. Mitten said opponents of the Wal-Mart Supercenter project at Spencer and Mexico roads planned to appeal the case within the next 10 days. Their lawsuit said the development would knock out small businesses and snarl traffic. They also said approval by the city’s Planning and Zoning Commission violated city ordinances and architectural restrictions in the area.
But St. Charles County Circuit Judge Jon Cunningham said in May that state courts had no jurisdiction. The opponents should have gone to the city’s Board of Adjustment first, he said.

GEORGIA SITE FIGHT: DULUTH ISN’T A FAN
Plans for new Wal-Mart not warmly welcomed in Duluth [Atlanta Journal-Constitution]
Plans to build a Wal-Mart SuperCenter are stirring controversy in Duluth.
At least 1,137 people have signed an online petition opposing plans to build a Wal-Mart SuperCenter on Peachtree Industrial Boulevard, between Chattahoochee Drive and Sugarloaf Parkway. Worried residents from surrounding neighborhoods are calling and sending e-mails to Duluth City Hall.
Wal-Mart has scheduled a public meeting to answer questions and address concerns. The meeting is to start at 7 p.m. Thursday at Red Clay Theater on Duluth’s Main Street.

Wal-Mart not giving up on Mary Esther store [NW Florida Daily News]
MARY ESTHER — Wal-Mart’s chances of moving into the city seemed to suffer a resounding defeat this week, but the issue still has its day in front of the City Council later this month.
The Mary Esther Local Planning Agency unanimously agreed to recommend against changing the zoning and land use for the property off Wright Parkway and U.S. Highway 98.
That recommendation goes before the council July 31, but because the LPA and council are composed of the same people, it’s not much a stretch to assume Wal-Mart faces more setbacks.
Still, Wal-Mart officials aren’t giving up.

MARY ESTHER - It was the meeting Wal-Mart supporters and opponents had been waiting for, and it had the feel of a main event.
At the end of the day, the visiting team went home empty-handed.
The city’s Local Planning Agency was unconvinced allowing Wal-Mart in was compatible with Mary Esther’s comprehensive plan.
The LPA voted unanimously to recommend denying a land-use and zoning change to the City Council.

Florida Site Fight: Wal-Mart Fights Decision
Wal-Mart fights decision [St. Petersburg Times]
BROOKSVILLE - Soon after the county denied Wal-Mart’s request to build a Supercenter on Barclay Avenue, County Commissioner David Russell said he expected the company to challenge the decision.
Not only was Russell right, but the company singled out his comments in a letter informing the county it wants to use a special magistrate to resolve the matter. If this is unsuccessful, the company retains the right to sue the county, said David Theriaque, of Tallahassee, Wal-Mart’s lawyer.
His letter to the county quotes Russell as saying at the May 9 meeting that commissioners are “here to analyze things not only objectively but also subjectively ... . That’s our right.”
This showed Russell was biased when he cast his vote to deny the right to build the store, Theriaque argued in the letter. He also noted that Russell and Commissioner Chris Kingsley had shown their bias by saying publicly, in the Hernando Times and other publications, that they planned to vote against the company’s request before the meeting.

Kentucky Site Fight: Wal-Mart Opponents Will Be Ready
August date set for Wal-Mart public Hearing [Cincinnati (Ohio) Enquirer]
Opponents of a planned Wal-Mart Supercenter in Florence say they will be ready when Boone County Planning Commission holds a hearing on the plan Aug. 1.
On Thursday, the commission set the new date after the scheduled hearing was canceled last week.
The hearing will be at 7:30 p.m. at Burlington Elementary School. Anyone for or against the Wal-Mart will be allowed to speak.
Wal-Mart wants to build a second Supercenter in Florence, at the intersection of U.S. 42 and Weaver Road. The store is asking the commission and City Council for a zone change for the 35-acre site, which is zoned industrial.
Rachel Warren, who heads Boone County Residents for Responsible Growth, came to Thursday’s meeting so she could tell the more than 100 members about the new date.
