Bloomberg is reporting today that Wal-Mart and the U.S. Chamber of Commerce are among those opposing legislation that would allow the U.S. to cut off duty-free imports from factories in Pakistan and Afghanistan, if they fail to adhere to international labor standards on matters such as prohibiting forced labor and child labor. The bill, titled the Afghanistan-Pakistan Security and Prosperity Enhancement Act, is meant to help strengthen democracy in the two countries by creating “Reconstruction Opportunity Zones” and increasing their ability to export goods to the U.S. - and in return, it only requires that the countries make sure their factories are providing adequate working conditions.

Wal-Mart, however, is among those arguing that such labor restrictions would reduce any beneficial effect the legislation might otherwise have - and besides, if factories in Pakistan can’t export products to the U.S. because of labor and human rights abuses, Wal-Mart can’t then turn around and sell those products at their everyday low prices, right?

“Pakistan doesn’t have a good record in terms of child labor and the employment of women,” [Susan Aaronson, a professor at George Washington University in Washington who has written on trade and human rights] said. “This ensures the rule of law will be followed.”

The House bill states that each country “shall continue to receive duty-free treatment under this Act only if the President determines and certifies to Congress that Afghanistan or Pakistan, as the case may be has implemented the requirements set forth” - said requirements including insuring the following:

(A) compliance with core labor standards; and
(B) compliance with the labor laws of Afghanistan or Pakistan, as the case may be, that relate directly to core labor standards and to ensuring acceptable conditions of work with respect to minimum wages, hours of work, and occupational health and safety.

We’ve already documented Wal-Mart’s sourcing issues in other international locales, so it shouldn’t be all that surprising that they would oppose such regulations here. Russell Simmons is a hip-hop pioneer. He’s an activist; a philanthropist; a role-model for young, disadvantaged youth.

But is he really launching a new line at Wal-Mart? And now???

Yes, apparently he is. On Feb. 15 Wal-Mart will roll out a new line of men’s clothing designed by Simmons in 350 stores - about 10% of its U.S. outlets - and on its Web site.

[T]he move seems surprising, especially as Wal-Mart flopped famously in its previous efforts to sell more fashionable, pricier clothing… But as Wal-Mart slows its store expansion, it needs to sell higher-profit items to continue generating growth, and apparel is one segment that can still draw new customers.

The clothing items will be priced anywhere from $10-30, not terribly expensive, but some analysts are still questioning the move. From BusinessWeek:

Still, the new line’s timing could not be worse, some analysts say, since Americans have chopped discretionary spending so dramatically.

As most apparel retailers announce job cuts and store closures because of sluggish sales, it is a precarious time for any of them to launch a new brand. But on Feb. 15 Wal-Mart Stores (WMT) will roll out a new line of men’s clothing designed by hip-hop entrepreneur Russell Simmons in 350 stores, about 10% of its U.S. outlets, and on its Web site. The launch will come less than a week after the world’s largest retailer announced that it will move buyers in the apparel division from its Bentonville (Ark.) headquarters to New York to increase the focus on fashion.

Nike Inc., the world’s largest athletic shoemaker, has sued Wal-Mart for allegedly selling footwear that infringes one of its patented designs. Or so says the footwear giant, who filed a patent infringement suit against the retail giant on Monday in federal district court in Illinois.

The case revolves around two of Nike’s designs, both having been patented back in late 2004. As you can see by photos included in Nike’s complaint, Wal-Mart’s shoe looks like a pretty spot-on match, at least design-wise. Kudos to Wal-Mart’s apparel design team - if your own products aren’t selling, why not copy those that do? And who wouldn’t want a shoe with pogo springs right in the heel?! I couldn’t find the offending models online, although most of Wal-Mart’s own athletic shoes appear to retail for between $10-25...I would guess the original Nike version sells for just a little bit more. Several Nike models, in fact, use the copied design and generally retail for $90 and above. You can draw your own conclusions, though my guess is that these two shoes are similar on face value only - it wouldn’t surprise me if for $15, Wal-Mart’s springs were filled with marshmallow or tiny foam peanuts.

The retail mega-chain has faced a couple of infringement suits already this year - recently by Pepe Jeans, and prior to that by Adidas, which settled its case with Wal-Mart in September. You can read more about those two instances here, here, and here.

WAL-MART AND THE ‘POORING OF AMERICA’
I’m not sure where the phrase “Pooring of America” came from, but it’s perfect to explain Wal-Mart’s effect on working families. Seeking Alpha ponders why Wal-Mart and McDonald’s are doing so well right now.

I am very intriqued by our top 2 choices for the “Pooring of America” trend - Walmart (WMT) and McDonalds (MCD) - what exactly are the charts above telling us?  If we are to enter a long drawn-out recession, which I have believed, these seem to be screaming buys here. The only question is credit - how does a lack of credit potentially hurt both. They are not expanding a ton, in the U.S. at least - perhaps with Wal-mart it’s financing of inventory, but I cannot wrap my mind around this behavior.

Will Wal-Mart weather the storm? To a point, it already is. Sure, all retailers are expected to have a dismal holiday season this winter, but Wal-Mart will do better than the competition. It has more stores, more pricing leverage and more wherewithal to hold customers hostage with lower prices and inventory turns at a time when it’s needed most. Perhaps we’ll see WMT return to the $60/share level by Thanksgiving—if not sooner.
